What Is Family Visa?  

A Family visa is a type of visa that allows foreign nationals to enter the United States based on their familial relationship to a U.S. citizen or lawful permanent resident (Green Card holder). It is a key component of U.S. immigration policy, designed to reunite families who are separated by national borders. Family-based immigration enables U.S. citizens and lawful permanent residents to sponsor certain family members to come to the U.S. to live permanently, and in some cases, temporarily. Types of Family Visas

  • The family member must fall into one of the specific categories outlined by U.S. immigration law.

Immediate Relative Visa

What Is Immediate Relative Visas?

Immediate Relative Visas are for the closest family members of U.S. citizens and have no annual limits, meaning there is no waiting list for visa numbers. The main immediate relatives include spouses, unmarried children under 21, and parents of U.S. citizens. Types of Immediate Relative Visas:

  • IR-1 (Spouse of a U.S. Citizen): For the foreign-born spouse of a U.S. citizen.
  • IR-2 (Unmarried Child Under 21 of a U.S. Citizen): For unmarried children under 21 years old of a U.S. citizen.
  • IR-3 (Orphan Adopted Abroad by a U.S. Citizen): For children under 16 years old who have been adopted abroad by a U.S. citizen.
  • IR-4 (Orphan to Be Adopted in the U.S. by a U.S. Citizen): For children under 16 years old who are orphans and are coming to the U.S. to be adopted by a U.S. citizen.
  • IR-5 (Parent of a U.S. Citizen): For parents of U.S. citizens who are 21 years old or older. The U.S. citizen must petition for their parent to come to the U.S.

Immediate Relative Visas allow U.S. citizens to bring certain close relatives to the U.S. for permanent residency (Green Card status). These visas are primarily for spouses, children, and parents of U.S. citizens.

Family Preference Visa

What Is Family Preference Visas?  

Family Preference visas are available for more distant family members of U.S. citizens or lawful permanent residents. These visas are subject to annual limits and may have longer waiting times due to the cap on visas per category and country.

  • F1 (Unmarried Sons and Daughters Over 21 of U.S. Citizens): For unmarried children over 21 years old of U.S. citizens. This category is subject to annual quotas, and applicants may face long waiting times.
  • F2A (Spouses and Children of Lawful Permanent Residents): For the spouse and unmarried children (under 21) of U.S. Green Card holders (lawful permanent residents). This category is often processed more quickly than other family preference categories.
  • F2B (Unmarried Sons and Daughters (21 and Older) of Lawful Permanent Residents): For unmarried children over 21 years old of Green Card holders. This category also has long waiting times.
  • F3 (Married Sons and Daughters of U.S. Citizens): For married children of U.S. citizens, regardless of their age. This category has long waiting times due to high demand.
  • F4 (Brothers and Sisters of U.S. Citizens): For siblings of U.S. citizens, but only if the U.S. citizen is at least 21 years old. This category often has the longest wait times.

H-4 Visa

  • Spouses and children (under 21) of H-1B holders can apply for an H-4 visa to accompany the primary visa holder.
  • H-4 Work Authorization: Certain H-4 visa holders (e.g., spouses of H-1B holders with an approved I-140 (Immigrant Petition for Alien Worker) can apply for an Employment Authorization Document (EAD), allowing them to work in the U.S.

K1 Fiance Visa – The K-1 Fiance Visa lets the foreign partner of a U.S. citizen legally come to the United States. After getting married, they can apply for a green card based on their marriage.
K-3 Spousal Visa – The K-3 Spousal Visa is intended to allow spouses of U.S. citizens to enter the United States temporarily while they wait to process their immigrant visa (IR-1 or CR-1) petitions.
